1. Introduction

1.1 By accessing and using any of the services offered by Euphoric Leisure or their nominated partners and management agents or through our offices (“booking services”), you agree to be bound by the terms and conditions set out herein. Euphoric Leisure may at any time modify these terms and condition and you are requested to review them periodically.

1.2 Euphoric Leisure reserves the right to refuse instructions relating to your booking. If you cannot transact on your own behalf, you may appoint an agent by submitting a Euphoric Leisure approved power of attorney and supporting identity documents to Euphoric Leisure for consideration. Euphoric Leisure reserves the right to accept or reject such mandate.

1.3 These terms and conditions constitute the entire agreement between yourself and Euphoric Leisure relating to the booking services. No failure or delay on the part of Euphoric Leisure in exercising any right or remedy hereunder or enforcing these terms and conditions shall operate as a waiver thereof.

1.4 Every effort is made to ensure the accuracy of the information provided by our office and contained online. Euphoric Leisure accepts no responsibility for any errors or omission and reserves the right to amend, vary, supplement, or cancel any of the documentation and information contained on our website.

1.5 Euphoric Leisure and/or its Homeowners shall not be held liable or responsible in any way in the event of an accident, death, injury, or loss suffered during the occupation of the premises howsoever caused.

2. General

2.1 You acknowledge that each property may be owned by a separate and distinct legal entity from Euphoric Leisure. Any additional fees prescribed by the property owner will be for your account. Euphoric Leisure accepts no liability for any costs and expenses incurred during your stay.

2.2 Euphoric Leisure accepts no liability whatsoever for any injury, death, loss, damage, accident, delay, or inconvenience suffered by you, your family and guests and any invitees at any property, arising from any cause whatsoever.

2.3 Maximum resort or property occupancy limits must be adhered to at all times. (If unauthorised maximum guest numbers are exceeded; Euphoric Leisure will be entitled to fine the guest and / or ask the guests to leave without a refund. By using the booking services, you irrevocably agree to leave the property (together with your family and/or guests,) on receipt of a request to do so).

2.4 No pets are permitted at any property unless it is clearly stated in the listing and confirmed in writing from Euphoric Leisure.

2.5 Check in time is from 15h00 and the property must be vacated by 10h00 sharp on the day of departure, unless otherwise sanctioned in writing by Euphoric Leisure. An extra charge, or an additional half-day rate may be levied for any early arrival or late departure.

2.6 Guests will be charged a late check-in fee of R750 for any guests checking in after 22h00 on Fridays and 19h00 on other days. This fee will be invoiced and due prior to check-in.

2.7 Upon arrival, guests are to inspect their property and the contents thereof and report any damages, breakages, deficiencies, or faults to Euphoric Leisure immediately; failing which, it will be assumed that the damage was caused by yourself and a charge will be payable. Euphoric will typically deduct the amount due using the details supplied to them on the credit card authorisation form or from the pre-authorised damage deposit, failing this Euphoric will invoice the client and the client is obliged to pay within 24 hours.

2.8 No smoking is permitted inside any of the properties. Euphoric Leisure will be entitled to fine the guest and / or ask the guests to leave without a refund should they smoke in the property.

2.9 Guests are to leave the premises as they found them and in a tidy and orderly fashion.

2.10 Property contents are not to be removed from the premises at anytime. Should items be moved off the property, regardless of intent, guests will be liable to pay the replacement costs for all misplaced or missing items.

2.11 Euphoric Leisure reserves the right to claim from you any costs relating to premises left excessively dirty and any breakages or damages to the material structure or content of the premises, including but not limited to all appliances, golf cart, linen, crockery, cutlery, bathroom amenities provided and furnishings.

2.12 The Rules of the Estate, together with the Rules of the Body Corporate are to be strictly observed. Euphoric Leisure pride themselves in offering upmarket self-catering villas and have the interests of all stakeholders at heart. These include the client AND the property owner, the estate and the residents and fellow guests of the establishment. Euphoric therefore reserves the right, NOT TO quote or even cancel bookings without refund in the following circumstances;

  • Where clients are planning a party.
  • Where there are guests under the age of 25 with no accompanying parent.
  • Where noise and /or any disturbance is anticipated.
  • In the event that guests breach our terms, we reserve the right to fine them and expel them from their accommodation with no refund. In these instances we also reserve the right to blacklist the clients and ban them from utilizing our properties in the future.
  • Where illegal activity of any nature is suspected, such as, but not limited to, the use of drugs or other illegal substances, or the solicitation of prostitutes. 

2.13 Euphoric Leisure reserves the right to recover from you any costs or fines incurred due to any breach of the Body Corporate and / or estate rules (speeding fines, tailgating, making excessive noise, damages, etc), or transgression of the law or by-laws in which the property is situated.

2.14 The guest will forfeit their full security deposit in the event that they breach any of the terms and conditions in this agreement and communicated to them otherwise, and will be liable for any additional associated costs.

2.15 The guest will forfeit their full damage deposit in the event that illegal activity of any kind is suspected. This includes, but is not limited to, the possession of illegal substances, and/or the solicitation of prostitutes.

2.16 Guests are required to complete the damage protection required for the property they have booked at least 48 hours prior to check-in. Guests with outstanding damage protection will be NOT be allowed access to the property under any circumstance: 

2.16.1 Guests who do not complete their security deposit via a credit card hold must pay, in full, the quoted refundable security deposit for their stay, before they are welcome at the property. Failure to pay the deposit may result in cancellation of the booking without refund. The security deposit will be repaid to the guest within 10-14 working days less any breakages or penalties for breaches that may occur during the guest's stay. Claims against the security deposit will attract a 15% service fee charged on the total value of damages and/or fines. 

2.17 Euphoric Leisure reserves the right to cancel any booking without refund where a guest or other guest(s) on the guest list are on Euphoric Leisure's internal blacklist. Euphoric Leisure, may at its sole discretion, choose to go ahead with the booking despite this if a mutual agreement on the way forward can be reached between both parties. In this event, the guest may be required to pay a minimum R10,000 refundable security deposit via EFT before the booking is able to proceed and guests are able to gain access to the property.

2.18 The guest acknowledges that bathroom amenities provided are not to be removed from the property. If a guest either removes bathroom amenities from the property, or damages any of the bottles, they understand that they will be charged per amenity removed/damaged at a fee of R100 per bottle (excluding the delivery and service fee).

2.19 Euphoric Leisure and its Homeowners accept no liability whatsoever for the interruption or failure of third party services offered at the property, including Internet, DSTv and the like. In the event of interruption or failure of a third party service, Euphoric Leisure and its Homeowners will do their best to resolve it with the relevant service provider, however cannot guarantee a resolution. Guests will not be entitled to any refunds of any nature in this event. 

2.20 In the event that guests soil the property's linen, couches, headboards and/or other fabric covered objects; 

  • 2.20.1 Guests must understand that Euphoric Leisure and its Cleaning Company associates are not responsible for removing linen/fabric stains caused by guests that are not removable by a general wash after their departure.
  • 2.20.2 Despite this, Euphoric Leisure and its Cleaning Company associates will do their best to remove/repair the stains and/or damages, but cannot guarantee it.
  • 2.20.3 If the linen/fabric does not come clean after washing, guests will be charged to replace these items and they will be made available for collection for a maximum of 2 weeks post check-out. Postnet is an option to send linen to guests at an admin fee of R450 that must be paid and cleared before anything is sent (at the guests own risk). If the soiled linen/fabric comes clean after washing, guests will be charged an extra cleaning fee of R350 (subject to change).
  • 2.20.4 Guests must understand that these sorts of treatments can cause damage to the integrity of the linens and/or fabrics and only suitable products will be used to maintain the integrity of the linen/fabric to avoid damaging it beyond repair. 
  • 2.20.5 Guests are not allowed to collect soiled linens or fabrics in an attempt to clean/repair them themselves.

2.21. In the event that guests block any of the toilets, they will be liable for the costs to remedy the situation. Guests are therefore reminded that only toilet paper is to be flushed down toilets. 

2.22. The accommodation is for short-term residential rentals only. It is not for events, functions, parties, receptions, meetings, commercial use, or guests above the registered number.

2.23. Fines may be issued in the event that guests leave the property unlocked when they depart. Guests are responsible for any consequences of the property being unlocked. 

2.24. Guests who take the key(s) with them, whether it's by mistake or not, are liable for all costs and admin fees to return the keys to the property within 24 to 48 hours of check-out. Failure to do so will result in the guest being charged for a replacement set plus any fees to remedy any situation where access is any impacted for onsite staff or future guests. 

3. Reservation Terms and Conditions for Booking

3.1 A booking will only be secured upon payment of the full rate by way of EFT, paypal or credit card payment to Euphoric Leisure and return of an accepted quotation including these terms and our credit card authorization form.

3.2 A guest booking will only be secured upon an immediate payment of the relevant prepayment deposit made by way of EFT or credit card payment to Euphoric Leisure, with the outstanding balance to be paid no less than 30 days prior to arrival. Failure to do so may result in booking cancellation without refund.

3.3 Amendments to confirmed bookings may be subject to an administration fee and / or change of rate. Late booking fees and rates shall be determined at the time, should the booking be accepted. Late booking fees comprise penalties levied by the estate and administrative fees.

3.4 Any cancellation of bookings will be subject to the following cancellation policy unless otherwise informed at the time of booking or in the email quote:

  • 3.4.1 Guests can cancel free of charge until 31 days prior to their check-in date.
  • 3.4.2 Guests who cancel within 15 - 30 days of their check-in date will be charged 50% of the total booking amount.
  • 3.4.3 The guest will be charged the total booking amount if they cancel within 14 days of arrival.
  • 3.4.4 If Euphoric Leisure agrees to move a booking within 30 days of the orginal check-in date, the moved booking will be non-refundable and incur a R1,000 admin fee.

3.5 Guests are required to sign the Credit Card Charge Form and send it to [email protected]. This will authorise Euphoric Leisure to debit your credit card for any amounts owed to Euphoric Leisure including damages or loss caused by you during your stay.

3.6 All quotations are subject to availability and price fluctuations from time of booking. Quoted rates are subject to change.

3.7 In the event that the property is not up to our standard e.g. due to maintenance or repair, Euphoric Leisure reserves the right in its sole discretion to place guests in similar accommodation. In this instance, guests may be liable to pay additional charges in order for this to be facilitated.

3.8 In the event that a property is unable to fulfil on a confirmed booking, for whatever reason that is no fault of the guest or Euphoric Leisure, Euphoric Leisure reserves the right to cancel any confirmed booking and provide guests with a full refund minus any relevant platform fees, admin fees or agent commissions. Euphoric Leisure will do its best to find similar alternative accommodation but cannot guarantee it. Guests may be provided with the option to upgrade to different accommodation for an additional fee. Reasons for this may include but in not limited to the property being sold or rented to a long term tenant.

3.9 Where cleaning is included, guests acknowledge that this service extends to cleaning of the property ONLY and does not include cleaning/washing of personal items of any nature, including but not limited to clothing and shoes. The guest accepts full responsibility of their personal items should their request of the cleaner to wash/clean items of a personal nature be accepted. Euphoric Leisure and its partners, the cleaning company and cleaner accept no responsibility and will not be held liable for any damages caused to a guest's personal items.

3.10 The guest agrees that no alterations will be made to the guest list once the original guest list has been submitted. The only time when additional guests can be added to the guest list is if the maximum guests allowed at the property has not been reached. In this event, additional guests can be added until the maximum number of guests is reached up until 48 hours prior to check-in and no less without exception. Guests may be removed from the guest list, however guests are not allowed to replace these guests with other additional guests at any time.  

3.11 Quotes issued within 7 days of the check-in date must be settled in full within a 2-hour window to confirm the booking. Failure to complete the payment will lead to the deactivation of the quote, freeing up the dates for public booking. If you miss this payment deadline and another guest reserves and pays for the booking, that booking will be honored.

4. Changes to Terms and Conditions

4.1 These Terms and Conditions, and/or any fees payable to Euphoric Leisure in terms hereof, may be changed from time to time at the sole discretion of Euphoric Leisure without notice to you.

4.2 No warranties, guarantees, undertakings or representations made by Euphoric Leisure, its Directors, officers, employees, agents, contractors, or servants, not contained herein, shall be of any force or effect.
